Protecting your personal data matters to us. Below we explain which data we process when you visit this website, for what purpose, and what rights you have.
This is a translation provided for your convenience. In case of any discrepancy, the German version of this privacy policy is the authoritative one.
1. Controller
The controller for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is:
NEUMEIER GmbH
Böhmerstr. 10
93437 Furth im Wald
Germany
Represented by: Rudolf Neumeier
Phone: +49 9973 8466-0
Fax: +49 9973 8466-20
E-mail: info@neumeier-gmbh.com
For any question about data protection, please write to the address or e-mail address above.
2. General principles
Personal data is any information relating to an identified or identifiable natural person. We process such data only where this is necessary to provide this website and our services, or where you have given us your consent.
Depending on the processing, the legal basis is:
- Art. 6(1)(a) GDPR where you have consented to the processing,
- Art. 6(1)(b) GDPR where processing is necessary to perform a contract or to take pre-contractual steps,
- Art. 6(1)(c) GDPR where we are subject to a legal obligation,
- Art. 6(1)(f) GDPR where processing is necessary for our legitimate interests and your interests do not override them.
We erase personal data as soon as the purpose of the processing no longer applies. Statutory retention obligations, in particular under German commercial and tax law (generally six or ten years), remain unaffected; during that period the data is blocked for any other purpose.
No automated decision-making, including profiling, takes place.
3. Hosting and server log files
This website is hosted by STRATO AG, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany. STRATO processes the data arising when the website is accessed on our behalf; a data processing agreement under Art. 28 GDPR is in place. The servers are located in Germany.
Each time a page is accessed, the system automatically records data from the requesting computer:
- IP address
- date and time of access
- name and URL of the file retrieved, volume of data transferred
- notification of whether the retrieval was successful
- the page visited previously (referrer)
- browser used, its version and the operating system
This data is technically necessary in order to deliver the website, keep it running reliably and detect and defend against attacks. The legal basis is Art. 6(1)(f) GDPR. Log files are deleted as soon as they are no longer needed to deliver and secure the website. They are kept beyond that only for as long as they are needed to investigate a specific security incident. This data is not combined with other sources.
4. Cookies and browser storage
Cookies are small text files stored by your browser. This website uses very few of them. We do not use any cookies for analytics, marketing or tracking. We also do not embed advertising networks, social media plug-ins or visitor statistics.
- pll_language – stores the language version you selected so that you return to it on your next visit. Lifetime: one year. This cookie is strictly necessary for the function you requested (Section 25(2) no. 2 TDDDG in conjunction with Art. 6(1)(f) GDPR).
- WordPress session cookies – only for staff who sign in to the editorial area. These cookies are not set for visitors to the website.
You can delete cookies or restrict their storage at any time in your browser settings. If the language cookie is blocked, the website is displayed in the default language.
5. Contacting us
Contact form
You can send us a message using the form on our contact page. First name, last name, e-mail address and your message are mandatory; the subject line is optional. Without this information we cannot process and answer your enquiry.
Your details are forwarded solely by e-mail to info@neumeier-gmbh.com and are not stored in the website database. Along with the message we also transmit the time it was sent and the page you wrote from.
To fend off bulk advertising messages, we derive a check value from your IP address and the current hour which cannot be converted back into the IP address. We use it to count how many messages originate from one connection. The value is deleted automatically after one hour. The legal basis is our legitimate interest in a working contact form (Art. 6(1)(f) GDPR).
The legal basis for processing your message is Art. 6(1)(b) GDPR where your enquiry is aimed at concluding a contract, and otherwise your consent under Art. 6(1)(a) GDPR, which you give when you send the message. You may withdraw that consent at any time with future effect, for example by sending us an informal e-mail.
We erase your data once your enquiry has been dealt with conclusively and no statutory retention obligations stand in the way.
E-mail, telephone and fax
If you contact us by any of these means, we process your details solely in order to deal with your request. The legal basis is Art. 6(1)(b) GDPR for contract-related enquiries and otherwise Art. 6(1)(f) GDPR. Please note that e-mail may be transmitted unencrypted over the internet.
6. Dealer map
On our „Dealers“ page we show our sales network on an interactive map. The mapping software needed for this is stored on our own server. The map image itself is loaded from OpenStreetMap, so that provider receives your IP address. Without this transfer the map cannot technically be displayed. The legal basis is our legitimate interest in an understandable dealer search (Art. 6(1)(f) GDPR).
- Map tiles from OpenStreetMap, OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom. Privacy information: osmfoundation.org/wiki/Privacy_Policy
- Place search (Nominatim) operated by the OpenStreetMap Foundation. Only when you enter a town or postcode and start the search are that search term and your IP address transmitted to Nominatim in order to determine the corresponding coordinates. The legal basis is your consent, given by actively using the search (Art. 6(1)(a) GDPR).
The „My location“ button lets your browser determine where you are. Your browser will explicitly ask for your permission. The coordinates never leave your device: the distance to our dealers is calculated in your browser only. We do not receive your location and do not store it.
7. Fonts
The „Montserrat“ and „Open Sans“ typefaces are stored on our own server and delivered exclusively from there. No connection to third-party servers – in particular not to Google Fonts – takes place. No data is transferred to third parties and no cookies are set.
8. Brochures and other downloads
You can download our brochures and data sheets without providing any personal data. Only the server log data described in section 3 is recorded.
9. Links to other websites
Our pages contain links to the websites of our dealers and partners and to our virtual factory tour. We have no influence over their content or their data processing. The privacy policies of the respective providers apply to those services. As soon as you click such a link, you leave our website.
10. Data security
This website is delivered exclusively over an encrypted connection. We use SSL or TLS encryption in line with current technical standards. You can recognise it by the address bar of your browser starting with „https://“ and showing a padlock symbol; requests made over „http://“ are redirected automatically to the encrypted address. As a result, any data you send us through this website – for example via the contact form – cannot be read by third parties.
We also take technical and organisational measures to protect your data against loss, destruction and unauthorised access. Backup copies of the website remain on our host’s server and are not transferred to third parties.
11. Recipients of the data
Your data is passed on only to the extent described above. The recipients are our host as a processor and the providers named in section 6, in so far as you open the dealer map. Beyond that we only pass on personal data where you have consented, where we are legally obliged to do so, or where it is necessary to perform a contract with you – for example to a dealer near you if you expressly ask us to. We do not sell data.
12. Your rights
You have the following rights against us in respect of your personal data:
- Access (Art. 15 GDPR) to whether and which data we process about you,
- Rectification of inaccurate data or completion of incomplete data (Art. 16 GDPR),
- Erasure (Art. 17 GDPR), unless a retention obligation stands in the way,
- Restriction of processing (Art. 18 GDPR),
- Data portability (Art. 20 GDPR),
- Withdrawal of consent given, with future effect (Art. 7(3) GDPR).
Right to object
Where we process data on the basis of legitimate interests under Art. 6(1)(f) GDPR, you have the right to object at any time to that processing on grounds relating to your particular situation (Art. 21 GDPR). We will then stop processing the data unless we can demonstrate compelling legitimate grounds which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
To exercise your rights, an informal message to the address or e-mail address given in section 1 is sufficient.
Complaint to a supervisory authority
Without prejudice to any other remedy, you have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is:
Bayerisches Landesamt für Datenschutzaufsicht (BayLDA)
Promenade 27, 91522 Ansbach, Germany
Phone: +49 981 180093-0
www.lda.bayern.de
13. Changes to this privacy policy
We will adapt this privacy policy whenever changes to our website or to legal requirements make that necessary. The version published here applies to your next visit.
